Any land at any time that is a navigable waterway is owned by the government.
The land under it is also always owned by the state, it's called a riparian claim.
For it to be a navigable waterway it must be able to support commercial traffic, it will be identified on government survey maps, and it is under the jurisdiction of Congress.
